Terms of Service

Welcome to OurShift. These Terms of Service ("Terms") govern your access to and use of the OurShift marketing website (`home.ourshift.au`), the main OurShift web application (`ourshift.au`), and any associated services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.
1. Account Registration & Eligibility
To use the Platform and create a primary household account, you must be at least 18 years of age. By creating an account, you represent and warrant that you meet this age requirement.
Account registration relies on third-party authentication services. You are entirely responsible for maintaining the confidentiality of your login credentials and any "Family Join Codes" associated with your household. The Household Plan supports one family workspace with a defined member limit as outlined on our pricing page. You are responsible for all activities that occur under your account.
Minors: Children may participate in a household as members, each signing in with their own third-party authentication account, but only when invited by the primary (18+) account holder. The primary account holder is responsible for supervising a child member's use of the Platform, including any tasks, photos, or other User Content associated with the child's profile, and for obtaining any consent required under applicable law for the child's participation.
2. Acceptable Use & User-Generated Content
You agree to use the Platform strictly for lawful household, family, and roommate task management purposes. You must not:
- Upload, post, or transmit any content that is abusive, illegal, offensive, defamatory, or infringes on any third party's rights.
- Attempt to gain unauthorised access to the Platform, other users' accounts, or our computer systems and networks.
- Use the Platform to distribute spam or malicious software.
By submitting data, tasks, or other content ("User Content") to the Platform, you grant OurShift a worldwide, non-exclusive, royalty-free license to use, host, store, and display your User Content solely for the purpose of providing and improving the Platform.
3. Subscriptions, Billing & Cancellation
Access to certain features of the Platform requires a paid subscription. Subscription fees and billing cycles are clearly outlined during the sign-up process and on our pricing page. Prices are subject to change, but we will notify you in advance of any price increases affecting your subscription.
Billing: Payments are securely processed through trusted third-party payment processors. Subscriptions automatically renew at the end of each billing period unless cancelled.
Cancellation and Refunds: You may cancel your subscription at any time through the billing portal. Cancellation will take effect at the end of your current paid billing period. We do not provide refunds or credits for partial-month periods or unused time.
4. Intellectual Property
The Platform, including its original content, design, branding, and source code, is the exclusive property of OurShift and its licensors. You may not copy, modify, distribute, sell, or lease any part of our Platform or included software without our express written permission.
5. Disclaimers & Limitation of Liability
The Platform is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, OurShift disclaims all warranties, express or implied, including the implied warranties of merchantability and fitness for a particular purpose.
Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law (ACL) which cannot be lawfully excluded. If a guarantee under the ACL applies, our liability is limited, at our option, to supplying the services again or paying the cost of having the services supplied again.
Subject to the above, OurShift will not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Platform.
6. Termination
We reserve the right to suspend or terminate your account and access to the Platform immediately, without prior notice or liability, if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.
If the primary account holder deletes a household workspace, all associated data, including tasks, materials, rewards, redemption history, and notifications for every member of that household, is permanently deleted and cannot be recovered.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia. You submit to the exclusive jurisdiction of the courts located in Queensland for the resolution of any disputes.
